DEPARTMENT OVERVIEW
The Equity & Equal Protection Office is responsible for the administration of UCSC’s policies and procedures regarding discrimination and harassment on the basis of race, religion, disability, sex, gender, age and other protected identities including title IX. Our work includes stewarding complaint processes for students, staff, and faculty who have experienced discrimination and ensuring that members of our community can engage in protected activity free from retaliation. We are responsible for the University’s compliance with state and federal laws relating to discrimination to ensure that no member of our community is denied participation in an academic program or employment based upon a protected identity or engaging in protected activity. The Title IX office of the University of California, Santa Cruz is charged with ensuring University compliance with all Title IX related policies and procedures by responding to all campus Title IX complaints and reports. The Title IX office facilitates alternative resolutions and conducts formal investigations of complaints and reports filed by students, employees, and the public.

JOB SUMMARY
Reporting to the Associate Director, Equity and Equal Protection (EEP)- Harassment & Discrimination/ Deputy Title IX Officer, the selected incumbent functions as a resource and leader in a compliance specialty program or multiple programs within the Equity and Equal Protection Office. Assists in ensuring the location has comprehensive processes for investigations, and coordinated responses for compliance program(s) within purview. Ensures alignment with federal and state laws, and University policies and procedures. Provides guidance to other compliance professionals. Normally receives high-level oversight on assignments with general instruction provided on new or more complex compliance work.

JOB DUTIES
30% – Case Management
Develops methods and seeks opportunities to increase manager and staff awareness of ethics and compliance programs and associated processes. Attends staff meetings, creates website tools and communications, solicits feedback, creates, and delivers training.
Keeps abreast of best practices in advanced investigation techniques, ensures alignment with University policy and investigates practices accordingly.
Responds to high profile complaints or concerns. Participates or convenes committees or task forces in regards to issues with little precedence, requiring expedient and diplomatic action.
May assess initial complaints of harassment and discrimination (including sexual misconduct) to determine the merit of complaints; Interviews the impacted party, gathers relevant information, advises impacted parties of their rights and options. Maintains a high level of confidentiality and ensures appropriate documentation.
Implements supportive, interim, and remedial measures as appropriate and makes appropriate referral to Director of Investigations and Complaint Resolution for case management and complaint resolution.
Provides consultation and determines avenues for resolution, assesses potential liability, and advises managers and supervisors on appropriate corrective and remedial action.
Collaborates and consults with the EEP team regularly to monitor and manage incident reports to ensure an efficient and effective response to reported incidents.
Provides periodic, timely updates regarding the status of complaints received and investigations in progress to Associate Vice Chancellor (AVC) EEP.
Provides guidance, support, and oversight to ensure thorough and timely investigations. Ensures comprehensive written investigative reports that clearly identify the issues investigated, summarizes the evidence, correlates findings to University policy, and recommends appropriate remedial steps. Reviews investigation plans including timeline.
Conducts complex investigations of suspected and reported violations of laws and policies, including those with significant potential impact. Obtains legal opinions when appropriate to determine investigative activities. Liaison with investigators from other locations. Assists in structuring complex investigations, including identifying witnesses, policies, data resources and other evidence. Provides recommendations for resolution of issues.
Ensures accurate and thorough records and notes to ensure a well-documented investigatory process.
Stewards practices for comprehensive oversight of investigations from initiation through investigation, including monitoring cases for timeliness.
Provides consultation and information regarding Title IX and VAWA (Violence Against Women Act) requirements to all involved parties.
30% – Supervision
Manages a team of Senior Principal Investigators/ Complaint Resolution Officers and Principal Investigators/ Complaint Resolution Officers for EEP.
Responsible for onboarding and professional development plans for investigations and complaint resolution team.
Provides guidance to investigations and complaint resolution team, ensuring investigations are thorough, timely, and conducted in accordance with relevant University policy.
Provides writing support, coaching and development for investigators. Ensures comprehensive and sound investigative reports are submitted for administrative review to the Associate Director, Equity and Equal Protection Office – Discrimination & Harassment / Deputy Title IX Officer.
Provides leadership, guidance, education, and policy development to the organization on ethics and compliance, and provides day-to-day guidance and support as needed.
25% – Compliance
Leads committees and workgroups as needed to address policy issues, complaint response systems, and educational programs. Is a resource for relevant federal and state laws, University policies, local procedures, department case history and political environment.
Ensures local compliance in implementation and procedural policy requirements.
Collaborates with Office of the President (OP) and other location colleagues to address complex system-wide issues with significant impact. Topics may include security, integrity of information, conflict of interest and records data management. Typically represents OP or a location on system-wide committees. Represents collective viewpoint on issues.
Develops proposals and convenes or participates on committees and task forces to implement critical coordinated response systems. Confers with Office of General Counsel (OGC) and other colleagues as needed, to strategize and create plans to mitigate or circumvent risk.
Develops recommendations for policy revisions, identifying the benefits and ramifications. May provide leadership in obtaining input from key constituencies.
10% – Training and Outreach
Collaborates with AVC EEP, Associate Director EEP, Harassment & Discrimination/ Deputy Title IX Officer and Director of Prevention & Initial Response EEP/Title IX Response Team Coordinator, as well as other campus managers, to assess EEP’s educational and training needs for specific units and the campus as a whole.
Contributes content to campus Title IX training working closely with the Director of Prevention & Initial Response EEP/Title IX Response Team Coordinator and other EEP staff, System-wide Title IX Office staff, Staff Human Resources, Academic Personnel Office and others as appropriate.
5% – Special Projects
Performs other duties and special projects as assigned.
REQUIRED QUALIFICATIONS
Bachelor’s degree in related area and / or equivalent experience / training.
Advanced knowledge of the ethics and compliance profession, theories and systems of control and professional compliance and investigation standards.
Advanced knowledge of federal and state laws and regulations, case law, and guidance related to discrimination and sexual harassment in the educational and employment setting, including Title VI and VII of the Civil Rights Act, Title IX of the Education Amendments of 1972, Violence Against Women Act (VAWA), and California (CA) AB1825.
Broad and thorough knowledge of the compliance and ethics profession, theories, and standards.
Ability to extract, verify, compile and develop recommendations related to ethics and compliance programs, issues, policies and produces.
Advanced knowledge of the complexities of discrimination and sexual harassment, including sexual violence, in the postsecondary or employment setting.
Experience supervising or leading a team.
Experience investigating sexual harassment or equivalently sensitive allegations in an empathetic and confidential manner.
Ability to demonstrate professional judgment.
Demonstrated ability to develop and implement independent recommendations for action as related to complex and varying situations.
Demonstrated ability to conceptualize, analyze, and interpret compliance issues, policies, and regulations as well as complex written material and data, make recommendations, and effectively communicate results of analyses in written and presentation formats accessible to diverse groups,

Juris Doctor (J.D.) or professional degree in law.
Experience working with federal and state agencies.
Experience using a case management system.
Bilingual language skills.
Leadership expertise and political acumen overseeing sensitive investigations within a large, complex organization.
Thorough knowledge of the Clery Act and experience with Clery reporting.
Thorough knowledge of Whistleblower and Whistleblower Retaliation laws.
SPECIAL CONDITIONS OF EMPLOYMENT
Selected candidate will be required to pass a pre-employment criminal history background check.
Within six months of their hire, newly-hired Title IX Officers, Deputy Title IX Officers, Investigators/Case Resolution Officers and Hearing Officers must complete 16 hours of comprehensive training.
Continuing Title IX Officers, Deputy Title IX Officers, Investigators/Case Resolution Officers and Hearing Officers will complete at least ten hours of continuing education relevant to their job function annually, between July 1 and June 30. Employees have discretion to select trainings to meet this requirement, but must meet the hours requirements below at least every two years.
