LCD comprises of Legal, Compliance, Global Financial Crimes and Regulatory Relations.

The Legal Department provides guidance, requirements and procedures for understanding and complying with the laws, regulations and Firm policies that apply to our businesses.

The Global Compliance Department identifies applicable Compliance Obligations and maintains a Firmwide Compliance Risk management program, including Compliance Risks that transcend business lines, legal entities and jurisdictions of operation.

Global Financial Crimes is responsible for the development and governance of the Firm?s financial crime prevention efforts across all regions and business units. Global Financial Crimes is comprised of the Anti-Money Laundering (AML), Sanctions, Anti-boycott, Anti-Corruption (ACG) and Government and Political Activities Compliance (GPAC) programs.

The Global Regulatory Relations Group (GRRG) is responsible for strategic and centralized management of the supervisory activities of Morgan Stanley?s regulators and related developments globally, with a focus on regulatory reviews and examinations and continuous monitoring activities. GRRG serves as the central point of contact for the regulatory staff responsible for supervisory activities at Morgan Stanley entities and for timely reporting to Firm management and other governance or management bodies, as appropriate, on those relationships and supervisory processes, including areas of significant regulatory focus or concern.

LCD Center of Excellence ? Mumbai (LCD CoE) is a part of Morgan Stanley?s Global In-house Center, which provides global support to LCD and is an integral part of Firm and LCD strategy.

Legal Field Services The position is in Morgan Stanley?s Legal Field Services Unit (FSU). FSU is a consolidated point of legal contact for Morgan Stanley branch and support personnel. FSU is a part of the Broker Dealer Advisory Group of Wealth Management Legal and handles legal inquiries raised by Complex/Branch Risk Officers, Complex/Branch Management, Financial Advisors, Field Support Groups (i.e. National New Accounts, Operations) and other personnel in the firm’s retail brokerage branch system.

The offshore Legal and Compliance Department in Mumbai is a department of the Legal and Compliance Division and provides support services to the Legal and Compliance Division.
This position will address issues relating to outside (non-Morgan Stanley drafted) powers of attorney viz ?
o Review and outlining of the powers of the agent under the power of attorney and general legal matters that relate to powers of attorney applied to client accounts;
o Addressing branch inquiries;
o Conducting legal research;
Drafting a summary of the powers granted to the agent under a power of attorney and
o Advising branch personnel on relevant powers of the agent under the power of attorney and the law applicable to the powers of attorney.
Private Banking Group Private Banking Group Legal (?PBG Legal?) is a group within Wealth Management Advisory Legal that provides legal advice related to all banking and lending services offered by Morgan Stanley?s Wealth Management business, including mortgage products offered by Morgan Stanley Private Bank, N.A. (?MSPBNA?). ? Review legal documents related to mortgage transactions for accuracy and legal authority.
o Provide mortgage assignments ready for execution to the MSPBNA business
o Monitor and manage mortgage assignment process to ensure that assignments are properly recorded and are appropriately tracked through completion;
Branch Advisory Branch Advisory Legal is a group of attorneys and paralegals ? within Wealth Management Legal. Branch Advisory Legal encompasses the legal Field Services Unit (?FSU?), the Levies & Garnishment Unit (?LGU?), the Marketing Review Unit & the Field Coverage Unit.
o Receive and process matters submitted to FSU intake for review;
o Review and summarize Court Orders/letters of Guardianship/Conservatorship (?Orders?) and to assist the Branch.

o Levies & Garnishment Unit (?LGU?) ?
o Review of accounts through firm systems followed by appropriate action on any named accounts with assets;
o Perform distributions of set amounts;
o Other ancillary tasks such as entering matters into T360 and to retrieve LGU docs
o For Marketing Review Unit:
o Review proposed team names of our FA teams to check compliance with Firm policies and any trademark issues.
o Check data breaches reported through the firms Irespond system.
o Review accounts escalated to WM Advisory Legal by Fraud Operations (based upon activity related to Debit Card, ACH, Bill Pay, Wire Transfer, Check, or other) and take appropriate actions internally and with external regulators.

QUALIFICATIONS
Requirements

Experience

o Qualified lawyer LLB (LLM will be an added advantage)
o 2-3 years? post qualification experience
o Solid track record working in a professional environment

Knowledge

o Understanding of legal documents and terminologies
o Basic understanding and exposure to Power of Attorney will be an added advantage
o Basic understanding and exposure to general legal and estate planning concepts and terminologies will be an added advantage
o Should exhibit comfort working with technology and the ability to learn and display proficiency on technical systems and programs.
o Proficient with MS Office (Excel proficiency would be an added advantage)
o Knowledge of document automation, contract analysis and other legaltech software an advantage

Coverage

o Monday to Friday from
o EDT (March to November) – 12 PM to 9 PM IST (2.30 AM to 11.30 AM EDT)
o EST (November to March) – 1 PM to 10 PM IST (3.30 AM to 12.30 PM EST)
Flexibility on standard working hours for time sensitive matters (including India Public Holidays) is expected
o Periodic calls with US manager and team members
