Job Description : PRIMARY FUNCTION:
The India and South Asia Ethics and Compliance Counsel is responsible for providing strategic regional leadership in the deployment of Eaton’s I&SA ethics & compliance program, leading some aspects of Eaton Compliance programs, for independently leading (complex) investigations, providing recommendations to regional leaders, and for designing and providing compliance program items, training and communications that support Eaton Ethics and Compliance Strategy and maintain or reinforce a culture of compliance.
ESSENTIAL FUNCTIONS:
The incumbent will:
Carry out all ethics and compliance responsibilities delegated to the position by the Senior Director and Chief Counsel, Ethics & Compliance – EMEA-APAC and the Senior Vice President, Chief Ethics & Compliance Office.
Oversee and independently manages – also complex – investigations of ethics matters. Effectively collaborate with relevant stakeholders. Resolve complex matters, where fundamental principles do not clearly apply and where data appears to conflict. Manage, supervise or train co-investigators.
Whilst operating will little supervision, oversee countries or region, defining the specific program applicable to these, frequently developing new concepts and solutions.
Convey complex information, develops communication strategies, and persuades significantly diverse audiences. Reconcile multiple stakeholder perspectives to resolve conflicts
Act as a resource to employees and leaders for inquiries regarding ethics and compliance. Make critical evaluations of inquiries or matters as to the potential impact and ensure that all matters are referred to the appropriate resources within the Company.
Where appropriate, own one or several regional or global compliance initiative(s), define their components, implementation deadlines and go-to-market milestones. Own their reporting and change management associated needs. Assist with deployment of risk assessment program to assess, prioritize and manage legal and regulatory compliance risks.
Develop strategy or serve as point of contact and coordinate with the Ethics Office in effectively communicating ethics and compliance policies, procedures and practices to employees through publications, training and education programs.
Compile, analyze and report on matters affecting ethics and compliance, including trends and best practices for the Board of Director’ report.
Support the EMEA-APAC Ethics and Compliance Director in developing the most appropriate methods of enhancing employee awareness of the ethics and compliance program.
Act as a matter subject expert on key compliance component or expertise needed for the well performance of the tasks, such as Anticorruption, Data Protection or Employment / disciplinary laws. Coordinate focus groups, pilot tests and training rollouts of ethics and compliance initiatives. Review findings from internal audit reports and ensures that action plans are completed.
Act as the day-to-day lead for ethics and compliance and act as a business partner on all matters related to ethics and compliance.
Design and develop all Region-specific ethics and compliance programs and program elements and ensure the maintenance of a world class program in accordance with all underlying regulatory and business requirements.
Draft, develop, and review compliance-related policies, making them customer friendly and accessible for the audience.
Oversee and manage the tracking of compliance requirements and ensure reporting requirements are followed in accordance with all applicable laws.
Monitor and analyze regulatory updates from government agencies and determine the potential impact of any regulatory changes to both the compliance and ethics program and the business.
Develop and implement internal controls that can prevent and detect significant instances or patterns of illegal, unethical, or improper conduct.
Development, review and maintenance of data-driven metrics that will provide actionable insight for the continual development and effectiveness of the ethics and compliance programs
Preparation and in some cases presentation of materials for senior management.
Prepare periodic reports and evaluations on the compliance and ethics program.
Qualifications
SPECIALIZED KNOWLEDGE:
Legal qualification from an Asian jurisdiction – attorney of law required. Civil or business law qualified lawyer, with significant experience in Asia required. Any additional qualification, ideally Asia, eventually international, is a plus. Working experience with European labor laws is a strong plus.
Ideally 7 to 10 years of relevant experience; experience in an ethics, compliance and legal department in APAC, ideally with a large international multi-cultural business.
Experience with European works councils and employees’ representatives.
Minimum of one APAC language in addition to English required.
