Job Description : Position Overview
An incumbent in this position may be assigned to any county department that might require such a position; while various departments have different work environments and functions, all county departments must maintain an open and customer service-oriented environment, cooperate with other county departments and governmental entities, and keep accurate and timely records and information.

Job Summary: The Legal Assistant performs paralegal/legal assistance in support of a county legal office or court. This position assists lawyers by compiling facts, gathering information, and organizing evidence or documents for cases. Duties include preparing initial drafts of legal documents according to court rules and statutes; conducting research to support legal proceedings regarding specific topics, statutes, case law, court rules, and legislative history; and conducting legal research under the supervision of an attorney. Job Responsibilities
These duties are the essential functions and are not all inclusive of all duties that the incumbent performs.

Conduct research for and prepares drafts of, legal documents, and memoranda for attorney review and approval; analyze statutes, court decisions, and other legal authorities; research necessary facts and background information from other county departments, other agencies, and the public.
Prepare for closings, hearings, trials, and meetings by gathering information, compiling facts, and organizing case information. Review evidence for cases and ensure that all relevant information is included. Identify appropriate laws, judicial decisions, and legal references that are relevant to assigned cases. Review legal material for internal use and maintain reference files. This all involves close coordination with an attorney(s), as well as discretion and judgment to determine when a legal action or document requires an attorney”s review.
Provide technical and support assistance to attorneys preparing evidence in a wide variety of legal matters, including documents, files, exhibits, and other evidence. Conduct support legal research, including reviewing legal journal entries; retrieving and verifying quotes and citations for legal briefs; and compiling information for attorneys. Use databases to track documents, pleadings, depositions, and other legal proceedings. Assist with discovery requests. Prepare trial notebooks; take notes during depositions and trials. May include assisting with depositions, witness statements, and hearings and proceedings.
May review, under the supervision of an attorney, contracts for compliance with statutes, court decisions (precedents) and other legal authorities.
Prepare written reports used in determining how certain legal proceedings should be handled based on analyzed and organized information. Help prepare legal arguments, draft pleadings, and motions to be filed with courts, and assist attorneys during trials. Organize and track files of all important case documents and to ensure they are readily available and easily accessible to attorneys.
Coordinate attorneys” research and completes reports, requests for information, and applications.
Answer and respond to telephone calls, including researching information requests, responding to discovery requests, and other requests.
Monitor calendar deadlines.
Complete proper court filings as required or necessary.
Develop, modify, and manage office systems and policies to maximize operational efficiency. Make arrangements for hearings, conference calls, and other appointments. Prepare and distribute accounting, expense documents, bills, or other records. May include managing office areas and functions, including supply rooms, copy rooms, or other office areas.
Keep and monitor legal volumes to ensure that law library is up-to-date. · Perform other duties as assigned.

Process incoming and outgoing mail. Non-Essential Functions:
Attend workshops, seminars, and educational sessions to keep updated on changes in assigned area of departmental responsibility.
Coordinate public hearings.
Perform a variety of miscellaneous duties such as running errands, picking up supplies needed for activities, making arrangements for use of county facilities, setting up tables and chairs, etc.
Maintain and troubleshoot computer systems by diagnosing and resolving routine computer equipment and software problems, make minor repairs to copiers and other equipment, and refer problems to other county staff or contractors when needed.
Knowledge, Skills and Abilities
Knowledge, Skills & Abilities – This position requires knowledge in state (MCA) and federal laws, legal codes, court procedures, precedents, government regulations, executive orders, administrative rules, agency procedures, and intergovernmental relations, including legislative processes. This position requires knowledge of administrative and clerical procedures and systems such as word processing, managing files and records, stenography and transcription, designing forms, and other office procedures and terminology; knowledge of the structure and content of the English language including the meaning and spelling of words, rules of composition, and grammar. This position requires communication skills, including written, orally, and active listening. This also involves the ability to communicate to a wide range of individuals, including explaining legal matters to non-attorneys.

An incumbent in this position may have frequent contacts with individuals who are in all stages of legal proceedings, and may encounter situations in which an individual is upset, abusive, and potentially violent, requiring an understanding of one”s environment and using good judgment on when to handle a situation or to call for another appropriate official. Legal Assistants must be able to document and present their findings and opinions to their supervising attorney. They need to understand legal terminology and have good research and investigative skills. An incumbent must be familiar with the operation and applications of computers in legal research and litigation support.

Legal Assistants should stay informed of new developments in the laws that affect their area of practice; participation in continuing legal education seminars allows paralegals to maintain and expand their knowledge of the law. Due to the public nature of the agency, an incumbent in this position should always comport themselves in an honest manner and uphold the ethical standards of the legal profession including respecting the confidential nature of information and records. Education Requirements
Requires education and experience equivalent to graduation from high school and three to four (3 to 4) years jobrelated work experience. Prefer previous experience working in a law office performing legal assistant duties, and responsibilities under the supervision of a licensed attorney. A paralegal degree is comparable with the four (4) year experience requirement. Other combinations of education and experience, as required at 25-10-305, MCA, will be considered.

The job requires freedom from illegal use of drugs and freedom from use and effects of drugs and alcohol in the workplace.

Persons who have been found guilty by a court of law of abusing, neglecting or mistreating individuals in a health care setting are ineligible for employment in this position.
