Montana’s Division of Criminal Investigation (DCI) is a diverse public safety team of professionals who provide a full range of criminal investigative services to state, local, and tribal law enforcement. From homicide investigations to illegal narcotics, criminal records, cybercrime, human trafficking, missing persons, or through training and certifying public safety officers, DCI serves as the hub in providing critical law enforcement support. Our diverse customer base includes protecting our vulnerable population, managing the sexual and violent offender registry, serving as the hub of communication for criminal justice information networks and the storage of criminal records, conducting arson investigations, as well as providing intelligence analysis support for local law enforcement. Many of our positions within DCI go without public recognition but remain the lifeline of support for public safety. Job Overview:
The Regional Agent in Charge (RAC) is responsible for management of staff and the office. This involves recruitment and selection, assigning and reviewing work, training, establishing performance standards, evaluating performance, handling corrective action, and recommending termination if necessary. This work requires knowledge of supervisory principles and practices, DOJ and State Personnel policies, procedures, and precedents, and employment law.
Supervises and coordinates the activities of agents conducting confidential, complex, and sensitive investigations, primarily relating to violations of dangerous drug laws. Daily (or hourly) decisions are made regarding how, or even if, an investigation should continue, weighing the outcomes versus the danger and liability. Extensive involvement in the decisions as to how to proceed in the investigation, preparation for prosecution, and maintenance of evidence. This must all be considered in conjunction with a thorough working knowledge of all drug laws, search and seizure laws, federal as well as state and local statues, and current court decisions and case law dealing with these issues, use of force, search warrant service, and civil liability.
Investigations:
Conducts confidential and complex investigations, as assigned, into allegations of felony violations of the Montana Criminal Codes. These investigations include, but are not limited to, homicides, organized crime activity, fraud, corruption, official misconduct, theft, and internal agency investigations. Determining the most productive method of proceeding with an investigation balanced against the potential health and safety concerns for agents and the public. Decisions made daily regarding use of informants, undercover officers, electronic surveillance equipment and techniques, and buy money. Coordination of investigations with various other law enforcement entities operating in the same area.
Knowledge:
Extensive knowledge of general investigative procedures, planning, supervising, report writing and coordinating the activities of criminal investigators; concerning developing, conducting and presenting complex long-term conspiracy-type cases; and all types of complicated equipment necessary to conduct criminal investigations.
Thorough knowledge of management, leadership, appraisal, and planning practices; methods and procedures used to conduct covert/undercover investigations; the effects and appearance of a myriad of illicit dangerous drugs that have been determined to be controlled substances; Montana Codes Annotated (MCA) dealing with crimes (MCA, Title 45, “Crimes”), criminal procedure (MCA, Title 46, “Criminal Procedure”), rules of evidence (MCA, Title 26, Chapter 10, “Montana Rules of Evidence”), seizures related to contraband, criminal justice information and privacy/security regulations (MCA, Title 44, Chapter 5, “Criminal Justice Information”).
Considerable knowledge of budget, appropriation, legislative practices; applicable Federal Criminal Code; Montana Administrative Rules; and handling/controlling/accounting for significant amounts of money.
Skills:
Skill in the use of a personal computer and associated software and in the use of various law enforcement-related equipment used in investigation.
Abilities:
Ability to remain calm in very highly stressful/dangerous situations; to communicate effectively verbally and in writing; to establish working relations with other staff and criminal justice agencies; to make correct/legal/appropriate decisions in highly stressful/dangerous situations; to physically detain suspects, use firearms or otherwise use necessary force to effect arrests and protect the public; to be confined or in cramped conditions resulting from long-term surveillances; to give correct instructions/advice to the agents/investigators under his/her supervision in such situations; and to track complex financial and business transactions.
Ability to write technically accurate and readable reports; to drive a motor vehicle; to work independently by planning and scheduling own work to accomplish Bureau goals and objectives; to plan and conduct educational programs; to be flexible to respond as needed while working with a wide variety of policies and jurisdictions; to initiate investigations; to operate in an undercover capacity; to develop and maintain informants; and be creative and adept at adopting necessary role to complete an investigative assignment.

Qualifications:

Law enforcement training including the MLEA Basic course or its equivalent.
Current POST certification.
Valid Montana motor vehicle operator’s license.
Proof the applicant has met the MLEA law enforcement physical standards within at least the last six months.
Supervisory training or experience at least equal to one year at some level in a law enforcement agency. Additional law enforcement training, including narcotics investigation, surveillance equipment, computers, crime scene processing, accounting, financial investigations and first-line supervision desired.
Other combinations of education and experience than those listed above will be considered on a case-by-case basis.
A training assignment may be considered.
Two (2) years of college (preferably in a police science-related field) and seven (7) years of investigative experience with a minimum of four (4) years as a full-time investigator handling a variety of investigations comparable to those a state agent is expected to handle;
OR
Ten (10) years of investigative experience with a minimum of four (4) years as a full-time investigator handling a variety of felony investigations comparable to those a state agent is expected to handle.
